Terms And Conditions
- please ensure hair and make up is completed before arrival. (If you choose to do this)
- Clothing for females is provided by the photographer. Clothing for males is not.
- Males to wear smart trousers and neutral button up shirt
- Clothing for boudoir is not provided
- Everything for a newborn session is provided
This agreement is between Leatherland Photography, hereinafter referred to as the “Photographer”, Operating in and within the laws of the UK. Any package lists and price lists and/ or documents are integral parts of this contract. The contract terms, agreement are legally binding documents between the parties. Failure to comply with any section of this agreement is a breech of contract and may result in legal action being taken.
1. Scheduling Date
- The client should aim to book their session with maximum notice, ideally 6-8 weeks minimum. If the client cannot attend the dates offered, they can request alternative dates. The photographer will work with the client to maximise flexibility, if able to do so.
- newborn session, the session should be booked before baby’s arrival. Sessions are to take place 5-21 days after baby’s birth. Client must notify the photographer within 3 days of the birth to schedule a date within the suitable time frame. Clients are to make reasonable attempts at attending the offered session dates. If they cannot attend the date offered, then the photographer is obliged to offer an alternative date, subject to availability. If there are no alternative dates, or the client cannot attend after the photographer has offered an alternative date, Leatherland Photography is not liable to refund any retainer fee
- Maternity sessions are to take place between 28-36 weeks of pregnancy. If the baby arrives preterm then the maternity session fee can be converted to credit towards a newborn session fee or photos. If the client requests a maternity session exceeding the 36 weeks of pregnancy and the baby arrives early, then by booking a session exceeding the recommended date the client waives any right to a refund or credit should baby arrive before the session date.
- Boudoir experiences that include the use of a professional make up artist may need to be booked up to 6 months in advance. If the session is required on a weekend this time may be doubled.
2. Change of date or location
- The photographer must be notified immediately of any changes in schedule or date, once formally agreed, at least 72 full hours from time and date of scheduled event
- A fee of £15 will be payable if the session needs to be rescheduled 14 days or less from the session date. If less than 72 hours this will be deemed as a cancellation and will require a new booking.
- Notification of any changes can be made by phone along with written notice sent via email for documentation.
- The photographer will do their best to accommodate these changes and offer alternative session dates (relevant charges may apply). If there is no alternative date the client must attend their already scheduled appointment or waive their right to a refund either in full or in part.
- Any sessions booked from October 2024 may have their location amended to SPILSBY. This is due to a studio move. If clients are unable to attend either location then it is at their discretion to bool, with the understanding that no refunds will be issued due to the change in location. Any sessions booked will be notified of the moving date.
3. Collection Policy
- Prints and product are collection only unless express service Is paid (see section 8)
- Orders must be collected within 10 working days
- Collection is week days only
- Collection is evenings after 4pm only
- Clients are to collect their own images, as this is a final proofing opportunity.
- Clients will be required to sign for their products.
- After the collection period has passed the photographer reserves the right to dispose of any prints or products not collected.
- A £10 reprint charge will be applied to these orders not collected within the time frame, that then wish to be collected after the products have been disposed of. This is a flat fee for all orders.
4. Cancellation
- There shall be NO refund of any monies after booking.
- A cancellation fee of £30 will be incurred for model sessions cancelled at any point after securing the session, for any reason. This fee applies to all sessions, including competition wins, model calls or free sessions.
- A fee of £15 will be payable if the session needs to be rescheduled 14 days or less from the session date. If this is within 72 hours of the session date a New booking will be required. There will be no refunds of the session fees already paid.
- Any fees not paid within 14 days of the invoice being issued will be charged manually to the card.
5. Late Arrivals
- Clients are expected to attend their session punctually.
- A grace period of 5 minutes will be allowed to accommodate for traffic and unforeseen circumstances.
- It is the client’s responsibility to plan their journey, and ensure they are aware of the location before the session date.
- It is to be understood by the client that any queries should be asked prior to the session date as the photographer may not be contactable on the session date.
- In the event the client arrives exceeding the 5 minute grace window, the photographer reserves the right to cancel the session with no refund. Models may be charged the cancellation fee.
- It is considered good practice for the client to notify the photographer of any expected delays as soon as possible.
- Any session time lost due to late arrivals will be deducted from the session time. This may result in fewer images or a less varied gallery. In the event of a mini session (approx 15 minutes) the session will not commence.
6. Refunds
- In the event of a cancellation no refunds will be issued.
- As established in the Creative Licencing section of this agreement, the photographer is entitled to full creative rights. It is of the photographer’s responsibility that all work presented to the client is in keeping to the photographers advertised work, and within the standard as advertised. It is the responsibility of the client to research and understand the portfolio of the photographer and the creative style, including the quality of work expected. There will be no refunds issued if images are not to the clients taste or liking.
- No refunds will be offered in full or in part after orders are placed.
7. Payment plans
- Payment plans are available for additional custom orders (prints, digital images and albums). Payment plans are offered at 0% APR.
- Payments are to be made in instalments by the client to the photographer.
- No images will be released until the outstanding balance is paid in full.
- Missed payments will incur a 5% charge.
- If further payments are not made, and the client makes no attempt to contact the photographer within 72 hours of the missed payment, then payment plans and orders will be cancelled with no entitlement to a refund, either in full or in part.
- If the client chooses to end the payment plan agreement, they should do so in writing to the photographer via email. The photographer will release goods to the value of the balance paid. It is at the photographer’s discretion what goods are sent pertaining to the balance paid. No partial refunds will be considered.
- Session fees that are on payment plans will not have a date scheduled until the balance is paid in full. If the client is to cancel the session at any point after initiating payments, then any payments already made (if less than 50% of the session fee) are none refundable. Anything over may be refunded, if the session date has not yet been secured.
Where sessions have been secured with a deposit, the remaining payment is due a minimum of 7 days before the session (unless otherwise specified)
For all payments not made as a one off it is the clients responsibility to make their payments on time and of their own accord. It is the client’s responsibility to be aware of when payments are due and how much is remaining. Payments not paid on time may result in late payment fees or cancelled sessions. The photographer will not chase payments.
8. Express Service
- The express fee is a fee of £35 in exchange for priority service from the photographer.
- This express fee is to be paid after the session or at the time of placing and additional extras or custom orders.
- Express service reduces the post production time from 6 weeks to 3-5 working days.
- This fee also includes a reduced wait time for prints and wall art, instead of waiting for the monthly printing order. By purchasing the express service, an order will be placed for the clients prints within 2-3 working days.
- The express fee also includes the option to have products posted to the clients home address free of charge ( unless large wall art)
- . These orders are still subject to the same manufacturing time as regular orders (5-7 working days)
- Leatherland photography is not liable for any printing or shipping delays.
9. Processing times
Time between session and viewing appointment
- With express service: 3-5 working days
- Without express service: 6 weeks
Time taken to order prints/products
- With express service: 2-3 working days from balance paid in full
- Without express service: upto 31 days from balance paid in full. Printing orders places once per calendar month
Time taken to manufacture products
- 5-7 working days from the date photographer places order
Shipping times
- With express service: International priority shipping. Upto 7 days from dispatch
- Without express service: Standard international shipping. Up to 21 days from dispatch.
Time taken to send digital images
- With express service: 2-4 working days
- Without express service: 5-7 working days
- Preselected images: 5-10 working days from balance paid in full
**These are a guideline only. Digitals may take upto 21 days. Prints and products may take upto 8 weeks.
10. Preparation
- The client shall ensure suitable and plentiful supplies are brought with them to the session.
- It is the client’s responsibility to have read, understood, and comply with all the information supplied or outlined, by the photographer, including the website.
- It is the responsibility of the client to be aware of the time and location in which the session will commence and to arrive punctually to the session.
- It is the responsibility of the client to bring the appropriate supplies, clothes, underwear or any other garments specified by the photographer.
- The photographer reserves the right to refuse the session if the client is unprepared or lacks the required supplies. In this event the client is not entitled to a refund either ‘in full or in part.
- Clients are expected to research the photographer, their style and their prices before making payment.
- Prices are freely available on the website. These should be researched before booking.
11. Mini sessions
- Mini session bookings are made as all inclusive “packages”. Packages include images and session fees.
- Images are selected by the photographer unless “gold” package (10 images)
- No image viewing will be given for these packages.
12. Attendees
- During this session no additional images of the client or other attendees will be taken.
- Pets are not permitted to attend this session unless explicitly agreed beforehand, and alternative care is the responsibility of the client.
- Children are the sole responsibility of the client at all times.
- Any losses or damages resulting from the actions of any pets or children are the financial responsibility of the client.
- The photographer reserves the right to ask other children to leave at any point, if deemed a safety concern or distraction.
- Children should only be present in the studio for the duration of having their photos taken. They are then kindly asked to leave for the remainder of the session to go ahead without distraction. In the event a child cannot leave the session, the parents or guardian will be required to sign a waiver.
- Boudoir sessions must only be attended by those over the age of 18. Client’s should avoid bringing additional guests with them unless they are participating in the session. Carers are exempt from this rule.
13. Cooperation
- If the photographer is unable to perform in relation to children or other participants lack of cooperation then the photographer has no liability.
- The cooperation of participants is the responsibility of the client.
- The photographer will do their best to work with the participants and gain cooperation, but ultimately the photographer can only capture the events happening.
14. Image viewing and orders
- The photographer will schedule a Viewing once the images are ready.
- Orders will be places at this time. A deposit or downpayment will be required at this time.
- Viewings are hosted at the photographers studio where the client will attend in person.
- Photo viewings are from 7pm onwards.
- These images remain the exclusive property of the photographer until balance is paid in full
- Previews will be available to the client 6 weeks from the session, or 3-5 working days with the express service
- Images will be kept for 60 days from the date that proofs are made available to the client. If the client requests to extend the time, then a £30 storage fee shall be applied.
- Any orders are non-refundable in full or part after being placed. All orders are final.
- Only 1 viewing will be offered per session. Any Additional viewings may be charged
- Photos may not be fully edited at the time of the viewing.
- Additional and personal edits will be discussed at the time of the viewing. Any additional edits must be requested at this time.
- Any amendments requested once images are delivered will require a fee of £6 per image.Additional edits must be requested by the person who booked the session.
- images will not be fully edited at the time of viewing, therefore finished products will be a reflection of the photographers advertised work. No refunds will be given.
14.1 PRESELECTED IMAGES
- mini session photos brought as part of the mini session photo package, or preselected model images will not be viewed by the client unless specified in their package.
- Preselected images are selected based on the highest technical accuracy, and those that most meet the criteria of the model call. We cannot guarantee that preselected images will reflect your wishes.
- Prices for preselected images are calculated with the deduction of the deposit already accounted for. The listed price is the balance required.
- No additional changes or edits will be made to preselected images after distribution. Additional edits are only available during image viewings.
- No refunds will be issued for preselected images, unless images drastically differ from those reflected in the photographers portfolio.
- Preselected images will be sent via email 5-10 working days from balance paid in full.
- Digital Images will be selected by the photographer and sent via email.
14.2 FREE IMAGES
- free images are 6×4″ prints
- free prints can be upgraded to digitals for £10 per image
- Free images are selected by the photographer
- free prints are subject to the same collection policy as other prints and products, including the 10 day collection period. See section 3 for full collection policy.
15. Additional requests
- Any additional requests from the client should be made upon booking. These include but are not limited to, personalisation, specific images or poses, specific props or colours, additional images that are not outlined in the session guide. Example: “ A photo of the client with the child”. Its is at the photographer’s discretion as to if these requests are accommodated, and the photographer reserves the right to deny additional requests. Failure to make additional requests at the time of booking may result in your request being denied or unachievable. Any objection to image usage must also be made in writing upon booking.
16. Free/ winning session conditions & Gift vouchers – MODEL CALLS
- a security deposit must be made to secure the session. This deposit is only refundable after the session has taken place.
- To be eligible for deposit refund, model must inform the photographer no more than 24 hours after the session, that they do not wish to view or purchase additional images.
- Alternatively, the client can opt for their deposit to be deducted from any extras purchased.
- Returned deposits will be made on the last working day of each month
- Free sessions may only take place during usual working hours. Weekends and evenings will be subject to relevant charges, unless otherwise stated.
- Free session cannot be transferred from an already booked session.
- Clients are not to book or attend another photographer within 3 months of free session. This is regardless of if the session is with a trainee, ammeter or professional. This applies whether the session is held outdoors, at another professional environment or at the clients home. This also applies if booked by someone else, but the same people are participating in the photoshoot. If in any doubt the client is to contact the photographer to clarify. In the event the client breaches this condition, the session will be treated as a normal paid session, and they will be expected to pay the full session amount- this also applies to cancellation fees. This period is valid only for 3 months, and only for free sessions.
- Clients must consent to image usage. This includes but is not limited to- social media, advertising and marketing, display or information booklets. To revoke consent the full session fee must be paid.
- Photos are to be purchased separately
- Free images are only eligible with the purchase of additional images – unless otherwise stated
- Any free images are selected by the photographer.
- Free images are 6×4″ prints only.
- Free prints are subject to the collection policy.
- Model sessions are eligible for discounted “preselected” photos (November 2024 onwards)
- Preselected photos are for model calls only as a budget friendly alternative. Prices displayed are calculated with the model call deposit already deducted.
- Preselected images are selected by the photographer, without any requests or influence from the client. Images will be selected based on technical accuracy and the requirements of the portfolio. We cannot guarantee that the images selected as per the portfolio criteria will reflect that of your wishes.
- Models may choose their own photos if they wish, however these will be subject tot he usual pricing structure, with a 10% discount.
- To be eligible for a deposit refund, models must inform the photographer with 24 hours of their session if they do not wish to purchase additional images.
Gift vouchers
- Gift vouchers can be paid either as a single one-off payment or on a payment plan. The gift voucher will not be handed over until the payments have been made in full. Recipients of the gift voucher should contact Leatherland photography to sign all relevant paperwork and complete the appropriate booking information. Gift vouchers are none refundable. Recipients of gift vouchers are responsible for purchasing their own photos, unless photo credit is stated on the gift voucher. If the recipient is responsible for any potential cancellation charges once session has been secured.
17. Image storage
- Images will only be stored for 60days from the date that proofs have been made available to the client for viewing. After 60 days the images will be removed from all flash drives, cards, and external hard drives. These will not be recoverable. Once the photographer has delivered the images, either as physical or digital files, they become the sole responsibility of the client. From thenceforth the photographer has no liability in regards to the images. Once delivered, all files will be removed within the subsequent 10 days, unless specified otherwise by either party. Images will be used by Leatherland Photography to post on social media, information guides, and for in studio displays. To object to image usage consent please email Leatherlandphotography@gmail.com to explicitly state consent is not given. This MUST be done at booking. Consent may be withdrawn consent any images have been posted or used, however a £10 fee will be incurred. This is to compensate the time for images being prepared especially for web use.
18. Creative Licence
- Images are edited at the photographer’s discretion. Delivered prints and digital images may not include all images shot. The photographer reserves the creative rights to edit and release only those images deemed creditable as professional in quality and within the photographer’s artistic standards. The photographer reserves the creative rights to style sessions to their professional opinion. Any previews of images are proofs. By ordering images, the client is agreeing to and accepting the standards and quality of the images. Once the client has paid in full, then no further alterations to the images may be considered, without the fee of £20 per image requiring alterations. If the session is a mini session in which the client does not view their image, alterations may be made if requested with 24 hours of receiving images. No refunds will be offered if images are not to the clients taste or liking.
19. Copyright
- The photographic materials including but not limited to negatives, transparencies, proofs and previews shall be the exclusive property of the photographer. The photographer shall own the copyright in all images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use, or for display within or on the photographer’s website, social media channels or studio. If the photographer shall make gallery proofs available through an online gallery or proofing website, or through in person ordering session, it is an offence to copy these images or attempt to remove the photographer’s watermark.
20. Photo and video footage
- Photos and videos of any kind are not permitted during any point within the session, by anyone other than the photographer. The photographer reserves the right to end the session with immediate effect should this clause be breeched. The client will have no entitlement to a refund either in full, or in part as a result.
21. Client usage
- The clients shall only use the prints, including digital files, in accordance with the permission within this agreement. The client’s images are for personal use only and should not be submitted to contests, reproduced for commercial use, or authorize any reproductions by parties other than the photographer. If the photographer provides a digital file print release, then the client must act in accordance with this release. Images will be used by the photographer for promotional material. If you do not consent to this you must email the photographer at the time of booking and express this in writing at the time of booking. Any withdrawal of consent after this will incur a £10 charge to compensate the photographer for their time preparing the images for promotional usage.
23. Failure to perform
- If the photographer is unable to perform this agreement due to illness, emergency, fire, casualty, act of God or cases beyond the control of the photographer, the photographer and client shall make every attempt to reschedule the session within the appropriate window suitable to conduct the session. If a reschedule is unable to be agreed upon, providing the photographer has offered alternative scheduling, then the photographer shall return all monies paid, less 50% of the retainer. If the photographer cannot offer any alternative dates, then the photographer shall return all monies paid. After retainer has been refunded to the appropriate sum, the parties shall have no further liability to this agreement. Further, if the photographer is unable to deliver photographic materials due to technological malfunction, including but not limited to, camera and processing, or otherwise lost or damaged without the fault of the photographer, then the liability of the photographer shall be void. No refund is attainable in these circumstances. It is at the photographer’s discretion to offer to reschedule a session, subject to availability.
24. GDPR
- Personal data given by the client will be stored, used and accessed by the photographer, and the photographer only. The client’s data will be used in accordance with the Data Protection Act 2018. Client data will be used strictly within the business relationship only. Client data will not be sold, given or accessed by any other third party.
By booking a session, you, the client, agree that you have read in full, understand in full, and agree in full to the terms and conditions set out in this agreement
